Few people believe in Law and few don’t, Few believe in “कानून के हाथ लम्बे होते हैं” and few believe in “अंधा कानून”.

.

According to the 2011 census Judge – Population ratio is 19.66 judges per million (10 lakh) people. In India, there are around 59,867 cases pending in the Supreme Court, 44.75 lakh cases in various high courts, and on the other hand the district and subordinate court levels, the number of pending cases stand at a 3.14 crore. Shocked? yes, I am also shocked.

People say that “कानून के हाथ लम्बे होते हैं“, but I don’t think that he has “लंबे हाथ”.It took 23 Years for the court to give justice to the victims (59 dead and more than 100 were injured) of Uphaar Tragedy, 7yrs to hang the convicts of the Nirbhaya case, and 5yrs to hang Lashkar-e-Taiba operative Ajmal Amir Kasab the main convicts of 26/11 attack in Mumbai.

Lajpat Nagar blast case, Three Kashmiri youths, Mohammad Ali Bhat, Lateef Ahmad Waza, and Mirza Nissar Hussain were arrested in 1996 and after 23 years in November 2012, High court has found all the three NOT GUILTY.

After a 31-year long legal war. In 2019 Supreme Court gave its verdict on the 1987 Hashimpura massacre case, wherein 16 policemen picked up and shot 42 Muslims in Hashimpura, Meerut. The bodies were later thrown into a canal.

Ismail Khan who is now 69, After a 41-year legal battle, was found not guilty of stealing Rs 20. In 2017, police in Bijnor, Uttar Pradesh, found that for 10 years, they had imprisoned a man for a murder he never committed. The murder was committed by his brother who was at large. Maqbool Shah was found innocent after being imprisoned for 14yrs.

“I might be a free man now but I feel I am in a bigger jail now. Even after seven years of acquittal, I am as isolated as I was in jail. Social boycott and stigma still continue,” Haider who was imprisoned for 8 long years, was wrongly accused of being a member of Hizbul Mujahideen, and Gopal Shete was kept in jail for 7 long years for a rape he never committed.

Gulab khan after being imprisoned for more than 12yrs was found Not Guilty. Gulab khan – “I had no connection with the terror attack but I was still framed. When I was arrested in this case, I thought that my life and also of my family had been destroyed. The thought of being framed in a terror case was scary. Over the years, I had severe anxiety pangs and thought that I might die of a heart attack.”

Vrinda Bhandari: A nation’s legal system is integral to how its citizens look upon issues that concern the country in general and their individual lives in particular. Despite having the world’s longest Constitution — not to mention, one that has gone through numerous amendments and the many directives by the Supreme Court that have secured the stature of de facto law, the Indian law books have struggled to evolve at a pace commensurate with the rapid changes society has undergone. As a load of being archaic becomes heavier on our law system.

Article 14 (6) of the International Covenant on Civil and Political Rights makes it mandatory for countries to have a statutory framework for providing compensation and rehabilitation to those who have been wrongfully prosecuted by the State. This provision is adopted by most of the countries but not by India. Do we have anyone who is accountable for this?


And hereupon I question the existence of Justice, Law, Government, and this system. Few say that “कानून के हाथ लम्बे होते हैं” and few believe in “अंधा कानून”, but I feel that “कानून का कोई अस्तित्व नहीं है”. I might sound a bit harsh but I have a valid reason to be soo.
